We dddailydeals.je are the operator of the website dailydeals.je. Our main trading address is 2nd Floor, 45 Halkett Place, St Helier, Jersey, JE2 4WG. We refer to ourselves as “we”, “us” or “our” in this document.

By using our site you accept these terms and enter into the “agreement” with us (the “Agreement” is annexed to and forms part of these terms)

By using our site, you confirm that you accept these terms of use and that you agree to comply with them. In these terms you are referred to as “you”, the “Customer” or “your”. Annexed to these terms is an agreement which sets out in more detail the arrangements between you and us and use of our site (the “Agreement“). The Agreement forms part of these terms and is to be read in conjunction with these terms.  

If you do not agree to these terms, you must not use our site.

We recommend that you print a copy of these terms for future reference.

These terms of use refer to the following additional terms, which also apply to your use of our site:

We may update and change our site from time to time to reflect changes to our products, our users’ needs and our business priorities.

We may suspend or withdraw our site

Our site is made available free of charge.

We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Our site is only for users in Jersey, Guernsey England or the UK

Our site is directed to people residing in Jersey, Guernsey, England or the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.

You must keep your account details safe

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security and/or registration procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@dailydeals.je.

How you may use material on our site

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

We are not responsible for websites we link to

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

Our responsibility for loss or damage suffered by you  

  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so.
  • We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
  • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
  • use of, or inability to use, our site; or
  • use of or reliance on any content displayed on our site.
  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.
  • Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. We will report any such attack to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such action, your right to use our site will cease immediately.

Rules about linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our site in any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with public policy. If you wish to link to or make any use of content on our site other than that set out above, please contact info@dailydeals.je.

Which country’s laws apply to any disputes?

This Agreement is governed by Jersey law. You and we both agree that the courts of Jersey will have jurisdiction.

The Agreement

 

  1. DEFINITIONS AND INTERPRETATION

 

In this Agreement the following expressions shall have the following meanings:-

Purchase” means the purchase of a Voucher to be redeemed for products and/or services advertised on the Website;

Service Provider” means the third party selling the product(s) or services advertised on the Website;

Voucher” means the voucher to be redeemed for the specified product or service; and

Website” means the website dailydeals.je

  1. WHAT IS DAILYDEALS.JE?

Dailydeals.je is a website that sells products and services. The Customer must register with dailydeals.je to be able to purchase such products and/or services.

By registering with dailydeals.je the Customer creates an account that enables payments to be processed and Vouchers issued.

The Website sets out clear instructions about how to register to enable the Customer to make Purchases (your name and a valid email address will be required).

It is not necessary to register to browse the Website, only to make a Purchase.

You must be 18 years old or over to register and make a Purchase. We reserve the right to decline a registration or to cancel an existing registration at any time.

  1. MAKING A PURCHASE – VOUCHERS AND REDEMPTION

When the Customer makes a Purchase it obtains a Voucher that is redeemed for the product(s) or service(s) acquired. The Voucher will be emailed to you by us automatically following your Purchase from the Website.

The provision of products and services are subject to certain conditions as detailed on the Voucher and the Website. It is your responsibility to read these conditions. It is also your responsibility to read and follow the instructions on the Voucher as to how to redeem the Voucher. Dailydeals.je is not responsible for any misunderstanding on your part about the conditions attached to the Purchase or the Voucher or redemption of the Voucher.

  1. CANCELLATION POLICY

If you change your mind you may cancel your Purchase within 7 working days from the day after the day that you receive the Voucher provided that the Voucher has not been redeemed. If you wish to cancel you must send an email to info@dailydeals.je or call us on 0800 086 9343 and must speak to an adviser rather than leave a voice mail.

  1. VOUCHERS – GENERAL INFORMATION

The safekeeping of the Voucher and related information (such as Voucher code) is your responsibility. Neither dailydeals.je nor a Service Provider are obliged to release products or provide services in the absence of a Voucher, nor are dailydeals.je or a Service Provider obliged to replace any lost, stolen or defaced Voucher.

It is the decision of the Service Provider whether a Voucher may be used in conjunction with any other offer or promotion.

Vouchers may only be redeemed in full.

Vouchers are for private use and may not be used for commercial purposes.  

The Voucher will expire on the date specified on the Voucher.

  1. YOUR RELATIONSHIP WITH THE SERVICE PROVIDER

You are contracting with the Service Provider and not dailydeals.je in connection with products and/or services to be provided by such Service Provider. The Service Provider and not dailydeals.je is responsible for (i) redeeming any Voucher you purchase in connection with products and/or services to be provided by them, and (ii) the quality of any product and/or service to be provided by them, at all times subject to the terms the relevant Voucher.

It is the Service Provider that is the seller of products and the seller/provider of services that are the subject of the Purchase offered by them on the Website and not dailydeals.je.

  1. REFUNDS

You may be eligible for a refund in the following circumstances, in which case please contact us and we will assess your situation on a case by case basis:-

  • The Voucher has expired and you were unable to redeem the Voucher with the Service Provider despite your best efforts and through no fault of your own.
  • You redeemed your Voucher within the time limit but the product or service did not comply with the description on the Website.
  • The business of the Service Provider has ceased to exist.

If a refund is provided then under relevant law you may reject the refund within 30 days. If not rejected then the refund is always in full and final and final settlement of your complaint.

  1. COLLECTION AND DELIVERY

If products are to be collected from an agreed collection point, we will contact you and advise when they are ready for collection. Vouchers must then be redeemed and products collected within 30 days of us contacting you.

If products are to be delivered to you, you will be required to provide a delivery address. Depending on the item, you may be required to pay postage and packaging or shipping costs in connection with the delivery, in which case you will be advised at the time you purchase the Voucher.

  1. DATA PROTECTION

We shall not disclose to any third parties any of your personal data, unless and except if (a) such disclosure is permitted under our terms of use including this Agreement, (b) we have your consent to do so, (c) such information is already in the public domain, (d) we consider it appropriate in the proper conduct of the matter, or (e) we are required or permitted to do so by law, or by the rules of a professional body, or by a governmental, judicial or regulatory authority.

 

  1. INDEMNITY

You shall indemnify us against any loss, liability or cost incurred by us arising out of (a) any breach of this Agreement by you, or (b) any claim(s) or legal proceedings brought or threatened against us arising from the use of a Voucher, or your use of the Website.

  1. LIMITATION OF LIABILITY

Other than as set out in our terms (under the heading “Our Responsibility for Loss or Damage Suffered by You“), our total liability to you or any third party under, in connection with, or arising from this Agreement shall not exceed the price paid for the relevant Voucher in respect of which any liability is claimed.

  1. GENERAL

You agree to use the Website appropriately and only for the purpose of browsing our deals and products and/or making a Purchase.

You acknowledge that any Purchase is made subject to this Agreement.

You agree that the details that you provide on registration are true, accurate and up to date.

We do not warrant the quality, usability, safety or any other aspect of a product or service that is the subject of a Voucher (although it is our intention and we are committed to only offer products and services on the Website, that we consider are, and believe to be safe, usable and of a good quality).

From time to time we may send you emails about updates to the Website, Vouchers and promotional offers. You may opt-out of such promotional emails by clicking on the unsubscribe link.

This Agreement constitutes the entire agreement and understanding of the parties in connection with the subject matter of this Agreement and supersedes any previous agreements, arrangements or understandings (whether in writing or not) between the parties relating to the subject matter of this Agreement.

Each of the parties acknowledges and agrees that in entering into this Agreement, it does not rely on any undertaking, promise, assurance, statement, representation, warranty or understanding (whether in writing or not), of any person (whether party to this Agreement or not), relating to the subject matter of this Agreement, save as expressly set out in this Agreement (unless made fraudulently).

If any provision of this Agreement is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed, and where capable the validity and enforceability of the remaining provisions of this Agreement shall not be affected.

Nothing in this Agreement shall be deemed to constitute a partnership between the parties or constitute any party the agent of another party for any purpose.

We shall not be liable for any breach of our obligations under this Agreement where we are hindered or prevented from carrying out our obligations by any cause outside of our reasonable control (for example, in the case of local or national emergency, accidental destruction of hardware, software systems, networks, databases, interfaces or facilities, the act or regulation of any relevant authority, fire, natural disaster, acts of God, war, hostilities, rebellion or terrorist activity).
